10 Things to Know About Annual Condominium Owners’ Meeting

It is very important that you know the 10 things about the Annual Condominium Owners’ Meeting in your condominium in Mexico.


1. Confirm your Legal Representation to attendance at the HOA meeting, this will depend on the way you bought your property.

  • a. Trust: Check the deed of your property, confirm if the Trust (bank) granted you the power to vote in the Assembly if not, you must request this authorization by writing to them;
  • b. Mexican Company: You must prove your personality by the power of attorney;
  • c. Mexicans: Simple power signed by two witnesses;
  • d. Co-owners: The holders must designate a legal representative.

2. Only you will have the right to vote if you pay your condominium fees and have confirmed your legal representation as owner.

3. The Vigilance Committee and administration cannot represent any owner in the HOA meeting.

4. None of the owners can represent more than 30% of the proindiviso in the HOA meeting. If this happened it will be required at least, half of the votes that represent the remainder of the proindiviso so that the agreements are valid.

5. Follow up proper protocol. Before any item can be voted on by the HOA meeting, it must be on the agenda.

6. Know and follow your homeowner's association's bylaws. This will help you understand better different issues, even you could find arbitrary or irregularities in the condominium and owners' doings.

7. Any modification to the bylaws must be agreed at the Extraordinary Meeting, which must be attended by at least 75 percent of the proindiviso.

8. Always maintain your property according to your bylaws and policies. If you will be making any additions to your home, remember to contact your HOA board and inform it for approval.

9. Know the members of the board and Maintain contact information on hand with information about who is in charge as HOA representative, to obtain important information about condominium and administration.

10. Take part! It is important to stay well informed and to be a part of the HOA Meeting and even volunteer to serve as part of the board.

    Hello. If an item is on agenda, can it be tabled or postponed under Mexican law or must it proceed to a vote? Can an owner move to postpone the vote? Do American “Robert’s rules” of parliamentary order apply in Mexico or is there a functional equivalent? Thank you
